1. Overview

This website is operated by HOUR 08 ("HOUR 08", "we", "us" or "our"). These Terms of Service ("Terms") govern your access to and use of the website hour08.com (the "Site") and your purchase of any products from us. By visiting the Site and/or purchasing from us, you agree to be bound by these Terms, including the policies referenced here, such as our Shipping Policy, Refund & Return Policy and Privacy Policy, which are incorporated by reference.

If you do not agree to these Terms, please do not use the Site or place an order. We may update these Terms from time to time, and the version published on the Site at the time of your order applies to that order.

2. Eligibility

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or territory of residence and have the legal capacity to enter into this agreement. You may not use our products for any illegal or unauthorised purpose.

3. Products and pricing

All prices are listed in Australian Dollars (AUD) and are subject to change without notice. We make every effort to display product colours, descriptions and specifications as accurately as possible, but we do not warrant that product images and descriptions are entirely accurate, complete or error-free, as colours may vary depending on your screen.

Our products are electrical lighting items. It is your responsibility to use them in accordance with the instructions provided and any applicable safety guidance. We reserve the right to limit the quantities of any products we offer and to discontinue any product at any time.

4. Orders and acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order, in whole or in part, at our discretion. This includes orders that appear to be placed by dealers or resellers, orders where a pricing or product description error has occurred, and orders we suspect to be fraudulent.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled items. In the event of an obvious pricing error, we are not obliged to supply products at the incorrect price and will give you the option to reconfirm at the correct price or cancel.

5. Payment

Payment is processed at checkout through our third-party payment providers. By submitting payment details, you confirm that you are authorised to use the payment method. We do not store full payment card details on our servers. Your order will be processed once payment has been received and cleared.

6. Shipping and delivery

Shipping, dispatch and delivery are governed by our Shipping Policy, which forms part of these Terms. Estimated delivery times are guides only and are not guaranteed. Risk in the products passes to you on delivery.

7. Returns and refunds

Returns, refunds, repairs and replacements are governed by our Refund & Return Policy, which forms part of these Terms. Nothing in these Terms excludes, restricts or modifies any consumer rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

8. Consumer guarantees and warranties

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, as described in our Refund & Return Policy. Except for those guarantees and any express warranty we provide, and to the maximum extent permitted by law, we make no other warranties, express or implied, in connection with the products or the Site.

9. Limitation of liability

To the maximum extent permitted by law, and other than for liability that cannot lawfully be excluded (including under the Australian Consumer Law), HOUR 08 will not be liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with the Site, the products, or these Terms. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the products or the cost of resupplying the products.

10. Intellectual property

All content on the Site, including text, graphics, logos, images, product photography and the HOUR 08 name and branding, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any content from the Site for commercial purposes without our prior written permission.

11. Acceptable use

You agree not to use the Site or its content for any unlawful purpose, to interfere with or disrupt the Site or its security, to transmit any malicious code, or to infringe the rights of others. We may restrict or terminate your access to the Site if you breach these Terms.

The Site may contain links to third-party websites or use third-party services (such as payment, fulfilment and analytics providers). We are not responsible for the content, policies or practices of third parties. Your use of third-party services may be subject to their own terms.
